1. Booking

These Terms and Conditions (“Terms”) apply to bookings made directly with Max Beach Costa Blanca for accommodation in our apartments in Orihuela Costa, Costa Blanca, Spain. Bookings may also be made through third-party booking platforms such as Booking.com or Airbnb. A booking becomes confirmed when the Guest receives a booking confirmation from Max Beach Costa Blanca or from the relevant booking platform. The booking confirmation will normally include the apartment, dates of stay, number of guests, total price and applicable payment and cancellation conditions. The person making the booking is responsible for providing accurate information and for ensuring that all members of their group comply with these Terms. Where a booking is made through a third-party platform, the platform’s own terms may also apply. Where there is a conflict, mandatory terms of the booking platform or applicable law will prevail.

2. Payment

Payment may be made through the booking platform or directly to Max Beach Costa Blanca by bank transfer, cash or another agreed payment method. Unless otherwise stated in the booking confirmation:

  • any required deposit is payable at the time of booking;

  • the remaining balance must be paid no later than 7 days before arrival;

  • bookings made less than 7 days before arrival may require full payment at the time of booking.

All payments must be made in euros (€). If a required payment is not received by the agreed deadline, we may cancel the booking after giving reasonable notice, unless different terms apply through the booking platform.

3. Check-in and Check-out

Check-in: from 3:00 PM on the day of arrival.

Check-out: by 11:00 AM on the day of departure.

Early check-in and late check-out are subject to availability and may be subject to an additional charge. Guests must provide the identification and other information required by Spanish law for guest registration. Where required by law, information relating to guests under 14 must be provided by the accompanying adult. We may be unable to provide access to the accommodation if legally required guest registration information has not been provided.

4. Prices and Additional Charges

The price shown at the time of booking includes the charges applicable to the booking unless otherwise stated. Additional charges may apply where they have been agreed in advance or arise from the Guest’s use of the property, including:

  • additional cleaning caused by excessive dirt or misuse;

  • damage to the property or its contents;

  • lost keys, access cards or other property belonging to us;

  • additional services requested by the Guest;

  • other charges clearly stated in the booking confirmation.

Any taxes or charges required by Spanish law will be applied as required by law.

5. Cancellation and Refunds

Unless a different cancellation policy is stated in the booking confirmation or on the booking platform:

  • cancellation more than 7 days before arrival: no cancellation charge;

  • cancellation 7 days or less before arrival: 50% of the total booking price may be charged;

  • no-show without cancellation: the full booking price may be charged.

Bookings specifically identified as non-refundable are subject to the applicable non-refundable booking conditions. Any refund due will normally be made using the original payment method. Nothing in these Terms excludes or limits any mandatory rights the Guest may have under applicable Spanish or European Union law.

6. Security Deposit

A security deposit of €200 may be required. The deposit may be used to cover reasonable costs resulting from:

  • damage to the property or its contents;

  • missing items;

  • lost keys or access devices;

  • exceptional cleaning caused by misuse of the property;

  • unpaid charges arising from the Guest’s stay.

The deposit will be returned after check-out once the property has been inspected and any applicable charges have been established. Where a deduction is made, the Guest will be informed of the reason for the deduction.

7. Occupancy and Use of the Property

The maximum occupancy of each apartment is stated in the individual apartment listing and booking confirmation. The apartment may only be occupied by the number of guests permitted for that apartment. The property is provided for temporary accommodation and must be used responsibly and in accordance with applicable law, building rules and these Terms.

Guests must not:

  • use the property for illegal activities;

  • sublet or transfer the accommodation to another person without our prior agreement;

  • organise parties or events without our prior written permission;

  • cause excessive noise or disturbance to neighbours;

  • exceed the maximum permitted occupancy.

8. House Rules

Guests must respect the apartment, the building, neighbours and common areas. In particular:

  • smoking is not permitted inside the apartment;

  • excessive noise, particularly during night-time hours, is not permitted;

  • parties and events are not permitted unless expressly authorised;

  • common areas must be used in accordance with the building’s rules;

  • guests must follow reasonable safety instructions provided by Max Beach Costa Blanca.

Pets are not permitted unless expressly approved by us in writing before arrival. Any applicable additional charge will be communicated before approval. The specific house rules applicable to the apartment will be provided to the Guest before or at the beginning of the stay and form part of the accommodation conditions. Serious or repeated breaches of the house rules may result in termination of the stay, subject to applicable law and the circumstances of the case.

9. Damage, Loss and Additional Cleaning

Guests are responsible for damage to the property, furniture, equipment or other contents caused by them or by members of their group, except for normal wear and tear. Guests must report significant damage or problems as soon as reasonably possible.

Where damage, loss or exceptional cleaning is caused by the Guest, we may recover the reasonable cost of repair, replacement or cleaning. Normal wear and tear will not be charged to the Guest.

10. Maintenance and Problems During the Stay

We make reasonable efforts to ensure that the property is clean, safe and in good working condition at the beginning of each stay. If a problem occurs during the stay, the Guest should contact us as soon as possible so that we have a reasonable opportunity to investigate and resolve it. For urgent maintenance issues, we will make reasonable efforts to arrange a solution as soon as reasonably possible. Some repairs or services may depend on third parties and may not be completed immediately. Nothing in these Terms limits any mandatory rights the Guest may have where the accommodation does not comply with applicable legal requirements.

11. Liability

We are responsible for providing the accommodation in accordance with the booking and applicable law. To the extent permitted by law, we are not responsible for loss, theft or damage to personal belongings brought into the property by the Guest unless such loss or damage results from circumstances for which we are legally responsible. Guests are responsible for taking reasonable care of their personal belongings. We recommend that Guests have appropriate travel insurance covering cancellation, medical expenses, personal belongings and other travel-related risks. Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.

12. Personal Data and GDPR

Max Beach Costa Blanca, operated by Michal Janusz Wykowski – Autónomo, is responsible for processing personal data in connection with bookings and stays.

  • legitimate interests of Max Beach Costa Blanca where permitted by law; and

  • consent, but only where consent is required and is the appropriate legal basis.

Certain personal information is legally required for guest registration in Spain. Where information is required by law, the Guest must provide it. Failure to provide legally required information may prevent check-in or provision of the accommodation. Personal data may be shared where necessary with:

  • Booking.com, Airbnb and other booking platforms used for the reservation;

  • payment providers;

  • guest registration and check-in providers, including Check-in Scan;

  • IT and service providers acting on our behalf;

In particular, records required under Royal Decree 933/2021 are retained for three years from the end of the contracted service. Other personal data will be retained only for as long as reasonably necessary for the purpose for which it was collected, to comply with legal obligations and to establish or defend legal claims. Guests may have the right, subject to applicable law, to request access to their personal data, correction of inaccurate data, deletion, restriction of processing, objection to certain processing and data portability. Where processing is based on consent, consent may be withdrawn at any time. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.

Requests concerning personal data may be sent to:

michael@maxbeachgolf.com

Guests also have the right to lodge a complaint with the Agencia Española de Protección de Datos (AEPD).

The AEPD is the Spanish supervisory authority responsible for data protection. Information about exercising data protection rights is available from the AEPD.

13. Guest Registration Required by Spanish Law

Spanish law requires accommodation providers to collect and communicate certain information about guests to the competent authorities. Guests must therefore provide accurate identification and other information requested for this purpose. Depending on the applicable legal requirements, this may include identification details, nationality, date of birth, habitual residence, contact details and information relating to the booking and payment. Guests may be required to provide a valid passport, national identity card, TIE or other legally accepted identification document. The information will be processed and retained in accordance with applicable Spanish law and data protection legislation. For professional accommodation activities, the applicable Spanish regulations require specified guest and transaction information to be recorded and retained. The statutory retention period for the relevant electronic records is currently three years from the end of the contracted service.

14. Tourist Accommodation and Legal Compliance

Max Beach Costa Blanca operates in accordance with applicable Spanish and Valencian legislation relating to accommodation. Where an apartment is classified as a Vivienda de Uso Turístico (VUT), the applicable registration and legal requirements will be complied with. The relevant tourist registration number and exact location of the apartment are provided in the individual apartment listing and/or booking information, where required by applicable law. The legal classification and requirements applicable to an apartment may depend on the nature and duration of the stay. Guests must comply with applicable Spanish law, Valencian regulations, local requirements and the rules applicable to the relevant building and apartment. For VUT accommodation in the Valencian Community, the applicable regulations also require users to be provided in advance with the relevant internal rules of the accommodation, including rules concerning coexistence, use of facilities and pets.

15. Force Majeure

Neither party will be responsible for failure to perform an obligation where this is caused by exceptional circumstances beyond reasonable control which could not reasonably have been avoided or overcome. Examples may include natural disasters, serious government restrictions, war, major infrastructure failures or other exceptional events. Where such circumstances materially affect a booking, we will communicate with the Guest and make reasonable efforts to find an appropriate solution. Any refund or other remedy will be handled in accordance with applicable law, the booking conditions and the circumstances of the event.

16. Complaints

If a Guest experiences a problem during the stay, they should contact Max Beach Costa Blanca as soon as possible. We will make reasonable efforts to investigate and resolve complaints during the stay where possible. Guests should give us a reasonable opportunity to resolve a problem before arranging alternative services at their own expense, except where immediate action is reasonably necessary for safety or to prevent significant damage.

17. Governing Law and Consumer Rights

These Terms are governed by the laws of Spain. Where the Guest is a consumer, any mandatory consumer protection rights and applicable jurisdiction rules will continue to apply. Nothing in these Terms is intended to remove or restrict any mandatory rights that a consumer has under applicable Spanish or European Union law.

18. Changes to These Terms

We may update these Terms from time to time. The version applicable to a booking will normally be the version accepted when the booking is made, unless a change is required by law or agreed with the Guest. Specific arrangements agreed in writing between Max Beach Costa Blanca and the Guest may supplement these Terms.
